Companies are resigned to the fact that Arthur Andersen is soon to be deceased.

If he is looking weary and resigned to the fact that he is probably going to die before it is over, and if he has a deep, almost hopeless desire to go home and forget it all; if he looks with dull, uncomprehending eyes at the fresh-faced kid who is talking about all the joys of battle and killing Germans, then he comes from the same infantry as Joe and Willie .

There has to be something that we don't know. To simply explain that they're doing this to avoid litigation assumes that they'd be willing to throw money down a rat hole.

This is not a populist demand for reduced compensation. This is a demand for more accountable compensation that in effect allows investors to relate pay to performance.

I suspect this rush to settle the civil antitrust actions and the securities class action are the product of both an approaching deal with the government involving a plea of guilty to criminal price fixing, and also the approaching shareholders meeting.
