We have decided to verify our conclusions as if an appeal was filed.

We are not trying to justify shooting at demonstrators but we cannot rule out that in specific cases, such shootings are justified because there is a threat to life.

We have filed an appeal to the Connecticut Appellate Court and intend to prosecute our appeal vigorously. We are confident in our position on this. We do not expect a final decision on the matter in 2006.

In preparing for trial and because of the motions she has filed to exclude witnesses I decided to re-file. I didn't want to risk this evidence not coming in.

Trust, but verify.

A verbal appeal is not enough, and we require a formal application. It has not yet been decided as to when sample B will be tested.
