There are people who feel malpractice cases go away because someone apologizes. I don't believe that. They go away based on their merit. Whether there's an apology or an acknowledgment of fault doesn't seem to be a key factor in the furtherance and continuing litigation in malpractice cases. The fact is more important than the admission of the fact.
