The Department's decision is shortsighted for a number of reasons, including the fact that some married same-sex couples would shoulder a heavier financial obligation to the state if their marital status were recognized for tax purposes.

They recognized the importance of the same-sex marriage decision. We're a bit of an egalitarian state, and we don't like elites making these decisions for us ... courts don't have the legitimacy it seems to me that a popular vote would have.

We are pleased to see that the court kept its eye on the prize—the children's best interests—and granted primary physical custody to the parent who is best able to provide a stable and loving home, regardless of biology. This means that even though there is often just one biological parent in families headed by same-sex couples, biology alone does not trump the best interests of the child.

That is significant for a number of reasons. If you add and additional driver, it costs you more money generally. If you simply add a spouse, it doesn't.
