The Commission cannot unilaterally take away a fundamental right of defense.

This would be the same as taking away the right to a hearing, or the right to respond to a statement of objections.

Transparency is vitally important in what can be a very opaque process in Brussels. We've decided to open this up so people can understand the issues.

There is nothing more that can be done. Everything we do is now available to licensees as well.

Last week the Commission said it was premature for Microsoft to allege they are riding roughshod over our rights of defense. Today we are less than a week away from the deadline for filing our response and have been denied access to the complete file, so I suppose it is now official and they are indeed riding roughshod over our defense rights.

We don't know how much of (the trustee's) report was the independent assessment of the experts and how much was a result of the Commission's influence.
