I don't understand why a law enforcement agency that has abandoned the use of the application of chemical agents on nonviolent protesters for seven years needs to litigate this issue in pursuit of a judgment that will essentially void the jury's decision and give local law enforcement agencies free rein to use pepper spray when none is needed in light of the 100 percent success rates since abandoning the use of pepper spray.

If we enact a law that makes clear we're going to dramatically increase enforcement without allowing greater legal flows, employers and illegal immigrants will find ways around it.

But it gives the law a little more bite.
